Summer Terms & Conditions

 1.Services Provided
 Damon Landscape offers the following services:

 Lawn Care: Lawn maintenance, fertilization, mowing, aeration, and other related lawn care services.
 Landscaping: Design, installation, and maintenance of garden beds, plants, trees, shrubs, and general outdoor aesthetics.
 Hardscaping: Installation of patios, walkways, retaining walls, fire pits, and other non-plant-based outdoor features.

 2. Estimates and Pricing
 Pricing: Prices are subject to change based on the scope of the project, site conditions, and material availability. Any changes to the estimated price will be communicated to the Client before work commences.
 Payment Terms: A deposit may be required before work begins. The remaining balance is due upon completion of the project unless otherwise agreed. Payment is due within 15 days of invoice issuance unless otherwise specified in the contract. Deposits are due before start of project date.

 3. Client Responsibilities
 Access and Site Conditions: The Client is responsible for providing clear access to the project site and notifying the Company of any obstacles or restrictions on the property.
 Utility Information: The Client must provide any relevant information regarding underground utilities, irrigation systems, or other obstacles that may affect the project.
 Permits: The Client is responsible for obtaining any necessary permits for landscaping or hardscaping work if required by local regulations.

 4. Work Schedule
 Commencement of Work: Damon Landscape will begin work on the project according to the mutually agreed schedule. Delays may occur due to weather, supply chain issues, or other unforeseen circumstances.
 Completion of Work: While we will make every effort to complete projects within the agreed timeframe, timelines are estimates and may vary depending on project complexity and site conditions.

 5. Warranties and Guarantees
 Workmanship: Damon Landscape offers a warranty on workmanship for a period of 6 months from the date of project completion. If any work performed by Damon Landscape fails due to faulty workmanship, we will correct the issue at no additional cost unless caused by
 Materials: Warranties on materials (plants, hardscaping materials, etc.) will be provided as per the manufacturer’s warranty or supplier terms.


 Exclusions from Warranty
 The following circumstances will void the warranty or may not be covered under our 6-month warranty:
 External Damage: Any damage to the project caused by outside factors such as natural disasters (e.g., floods, severe storms), accidents, or misuse by the Client or third parties.
 Improper Care: Damage resulting from improper care, maintenance, or neglect of the project by the Client or other parties (e.g., improper watering, soil erosion due to lack of maintenance).
 Third-Party Interference: Any damage caused by or related to the actions of another contractor or service provider working on the property after the project is completed.
 Alterations or Additions: If the Client makes alterations, additions, or modifications to the project without prior consultation and approval
 by Damon Landscape.
 Natural Conditions: Unavoidable natural conditions such as pest infestations, extreme weather events, or acts of nature that affect plant
 life, hardscaping, or the overall project.

 6. Changes to Scope of Work
 Any changes or additional work requested by the Client that were not included in the original estimate or contract may incur additional costs. These changes must be documented and agreed upon by both parties before work continues.

 7. Cancellations and Termination
 Client Cancellation: If the Client cancels the project after work has begun, the Client will be responsible for payment of any completed work or materials purchased for the project up until the point of cancellation.
 Company Cancellation: Damon Landscape reserves the right to cancel or reschedule work due to unforeseen circumstances such as extreme weather, safety concerns, or other conditions beyond our control.

8. Liability and Insurance
 Damon Landscape is fully insured for liability, and we will take all reasonable precautions to prevent damage to property. However, the Company is not responsible for damage to existing structures or utilities that were not disclosed by the Client prior to work commencing. The Client is responsible for maintaining adequate insurance for personal property and any valuables on-site.

 9. Acceptance of Terms
 By engaging Damon Landscape for services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions. This Agreement constitutes the entire understanding between both parties regarding the scope and terms of the project.
 

Upon the acceptance of the work, payment of the unpaid balance Contract Price when due together with such Value Added Taxes as may be applicable to such payment.
 

Should the Client fail to make payments as they become due under the terms of the Contract or in the event of any claim, interest at 25% per 2 weeks above the prime rate on such unpaid amounts shall also become due and payable until payment.


 The act of non-payment creates a lien in favor of the Contractor Inc. in any and all equipment and property of the Client in the possession of the Contractor Inc. as well as in the Work in progress as at the date of termination. the Contractor Inc. shall be at liberty to retain possession of the same pending payment in full.

Notwithstanding anything contained herein to the contrary, the completion date of the Work shall be deemed to be extended by that number of days equal to any delay in payment to the Contractor Inc.
