This agreement ("Agreement") is made between Damon Landscape LLC ("Contractor") and the client ("Client") for the provision of snow
removal services ("Services") at the Client’s premises. By signing this Agreement, the Client agrees to the terms and conditions outlined
below.
1.Services Provided
The Contractor will provide snow removal services including, but not limited to, plowing, salting, de-icing, and hauling away of snow piles.
The specific areas to be serviced will be identified in the Agreement.
• Minimum Snowfall Requirement: Snow removal services will be provided once the snowfall accumulation reaches 1 inch or more. If
services are required for de-icing or salting only, this minimum does not apply.
• Plowing Services: Driveways, private roads, and walkways will be plowed at a minimum of 1 inch of snow accumulation. Anything less
than 1 inch will be treated as property de-icing/salting only.
• Hauling Services: In cases where snow piles are too large for normal snow removal, hauling away snow piles will be charged at
$250/hour for the hauling service, plus the cost of rental equipment (e.g., skid steer & dump trailer).
2. Payment Terms and Conditions
• Contract Price: Upon acceptance of the work, the Client agrees to pay the full Contract Price, which will include any applicable Value
Added Taxes (VAT).
• Payment Due Dates: The full balance of the Contract Price is due when specified in the Agreement. Payments must be made by the
due date stated on the invoice.
• Late Payments: If the Client fails to make payments by the due date, an interest fee of 20% per month above the prime rate will be
added to the unpaid balance.
• Lien: In the event of non-payment, a lien will be placed in favor of the Contractor on all equipment and property of the Client in the
possession of the Contractor, as well as on any work in progress. The Contractor has the right to retain possession of the property and
equipment until payment is made in full.
• Delays in Payment: Should the Client delay payment, the completion date of the work will be extended by the number of days equal to
the payment delay.
3. Fuel Surcharge
If fuel prices exceed $4.25 per gallon, a fuel surcharge will be added to the invoice.
4. Damage and Liability
• Lawn Damage: Any damage caused to the lawn as a result of snow removal services will be repaired at no cost to the Client by Damon
Landscape LLC.
• Damage to Paved Areas: Damages to paved areas, including driveways, private roads, and walkways, caused by salt or snow removal
services are not included in the repair above and are the responsibility of the Client.
• Falls on Property: Damon Landscape LLC is not responsible for any falls or injuries occurring on the Client's property as a result of
snow or ice conditions during or after snow removal services.
5. Contractor's License and Insurance
Damon Landscape LLC is fully licensed and insured to perform snow removal services. Proof of insurance can be provided upon request.
6. Billing and Invoices
• Invoice Frequency: Invoices will be issued every 14 days for snow removal services provided.
• Payment Terms: Payments for invoices are due within 14 days of the invoice date. A late fee of 20% per month will be added to
overdue payments.
7. Agreement Duration and Termination
Once approved and signed, this contract is valid from the date of execution through the end of the snow season unless terminated by either
party. Either party may terminate this agreement with 14 days notice. If terminated early, the Client will be required to pay for all snow
removal services rendered up until the termination date.
8. Miscellaneous
• Entire Agreement: This Agreement constitutes the entire understanding between the Contractor and the Client regarding snow removal
services. Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Wisconsin.
9. Snow Removal Cleanup Service (Drifting Snow & Extra Accumulation)
In the event of drifting snow or additional accumulation beyond the standard snow removal service, Damon Landscape LLC offers a
cleanup service to address any extra snow buildup. Drifting snow can create unforeseen challenges, and we want to ensure that your
property remains clear, accessible, and safe.
Cost for Cleanup Service:
Rate: A cleanup fee of $150 per hour will be charged for any extra snow accumulation caused by drifting or excessive buildup after the
initial snow removal.
Scope: This service includes the removal of additional snow that has accumulated due to high winds or other factors beyond the normal
snow removal. The cleanup service will take place within 12 hours of the end of the snowstorm and will only be performed after
receiving approval from the client.
